Terms and Conditions for Sold Products in Australia

These Terms and Conditions govern the sale of products by GXN Group Pty Ltd (referred to as "we," "us," or "our") to you, the customer ("you" or "your"). By purchasing a product from us, you agree to these terms and conditions in compliance with Australian Consumer Law (ACL).

1. General Information

1.1. These Terms and Conditions apply to all product sales in Australia unless otherwise agreed in writing.
1.2. By placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.

 

2. Orders and Acceptance

2.1. All orders are subject to product availability and acceptance by us.
2.2. You will receive an order confirmation email once your order has been processed. However, this email does not signify acceptance of your order.
2.3. We reserve the right to cancel or refuse any order for any reason, including errors in pricing or product information.

 

3. Pricing and Payment

3.1. Prices are displayed in Australian dollars (AUD) and include GST unless stated otherwise.
3.2. Prices may change without notice. However, the price at the time of order confirmation will apply.
3.3. Payment must be made in full at the time of purchase. Accepted payment methods include credit/debit cards, PayPal, bank transfer.

 

4. Shipping and Delivery

4.1. We ship products within Australia. Delivery times and costs are outlined on proforma invoice.
4.2. While we strive to meet delivery estimates, we are not responsible for delays caused by third-party carriers or unforeseen circumstances.
4.3. Risk of loss and ownership of the product pass to you upon delivery to the address provided.

 

5. Returns and Refunds

5.1. Under Australian Consumer Law, you are entitled to a replacement, refund, or repair if the product is faulty, not as described, or unfit for purpose.
5.2. Change of mind returns may be accepted at our discretion. If accepted, the product must be unused, in original packaging, and returned within 10 business days of purchase.
5.3. Refunds for eligible returns will be processed within 5 business days of receiving the returned product. Shipping fees may not be refundable.

6. Warranty

6.1. Our products are covered by warranties in accordance with Australian Consumer Law.
6.2. If a product is faulty, you may be entitled to a repair, replacement, or refund depending on the nature of the issue.
6.3. Warranty claims do not cover misuse, accidental damage, or unauthorized modifications.

 

7. Liability

7.1. Our liability is limited to the replacement or repair of the product or the refund of the purchase price.
7.2. We are not liable for any indirect, incidental, or consequential damages arising from your use or inability to use the product.
7.3. Nothing in these terms limits your rights under Australian Consumer Law, including guarantees that cannot be excluded.

 

8. Intellectual Property

8.1. All intellectual property rights in our products, branding, and materials remain with us or our licensors.
8.2. You may not use our trademarks, logos, or content without prior written consent.

 

9. Dispute Resolution

9.1. In the event of a dispute, we encourage you to contact us directly to resolve the issue amicably.
9.2. If a resolution cannot be reached, disputes will be governed by the laws of Australia and resolved in the courts of Victoria.

 

10. Amendments

10.1. We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective from the date of publication on our website and apply to orders placed after this date.
